The Company is the sole interpreter of the intended and acceptable use of the website “www.kpoplacements.com”.

• Acceptable use by the Parties/Users who are Job Seekers/Prospects—The Company hereby grants the job seekers/prospects a limited, terminable, and non-commercial right to access the website “www.kpoplacements.com”. The Company provides authority to the job seekers/prospects to view and access only single copy of contents available on the website “www.kpoplacements.com”, solely for his/her/their own personal use. The job seeker/prospect agrees that he/she is solely responsible for the contents of any document (resume, blog or other contents) posted on the website “www.kpoplacements.com” and thereby any consequences arising from any such posting. The access of website “www.kpoplacements.com” is a privilege to the job seekers or individuals seeking employment and the Company reserves the right to suspend/terminate that privilege/access for any reason, at any time, without giving any notice in its sole discretion. The job seekers/prospects shall review the Terms and Conditions associated with each product and service offered to them by the website “www.kpoplacements.com”:     

• Resume Posting—This service is for the use of job seekers and is available free of cost on the website “www.kpoplacements.com”. The job seekers should agree to the following terms and conditions for the use of this service:

• The resume can only be submitted and modified by the intended job seeker alone, and free of cost.

• The Company provides no guarantee or warranty that there would be a desired response after submission of the resume by the job seeker on the website “www.kpoplacements.com”.

• Any job seeker uploading or posting resumes beyond specified limits, using same and/or several accounts shall entitle the Company to remove/cancel the account(s) without any notification to the intended job seeker.

• Any account holder on the website “www.kpoplacements.com” shall only feed his/her information on the website. The account holder cannot and is not permitted to submit the information and/or resume of person other than the “account holder” himself/herself.

• This is to notify that any prospective employer contacting or otherwise, the job seeker contacting any employer based on the information available on the website “www.kpoplacements.com”, shall do so at his/her/their own risk and responsibility. The company does not perform any background checks or checks pertaining to the existence or genuineness of the employer/job seeker.

• It shall be the sole responsibility of the job seeker to use privacy settings options wherever it may seem fit to debar or stop any other user/party (employers or consultants) from accessing his/her information. The Company shall not be liable in case this information is accessed by any such users.

• The job seeker using the services of the website “www.kpoplacements.com” does not claim any copyright and/or any Intellectual Property right over the data uploaded or posted by him/her on the website. It would become the intellectual property of the Company, once uploaded on this website.

• Any changes made by the job seeker shall come into effect only after 48 hours of such changes/modifications on the website “www.kpoplacements.com”.

• The Company has the authority to remove or delete and/or edit any information from the job seeker’s resume while uploading/posting on the website “www.kpoplacements.com”.

• Any disputes arising for whatever reasons from or related to the website “www.kpoplacements.com” and/or its use shall be governed by the laws of India. The Courts at New Delhi alone shall have the exclusive jurisdiction to hear and decide on any such dispute.       

• RSS (Really Simple Syndication)—This service is offered free of cost to the job seekers at website “www.kpoplacements.com”. For usage of this service, the job seekers should agree to the following terms and conditions:

• The service is offered to the job seekers/prospects for their sole personal benefit. They are prohibited from using this service in any form for commercial purposes. 

• The content and/or information provided in any form through this service on the website “www.kpoplacements.com” shall not be modified/edited/changed in any manner by the job seeker without prior written consent of the Company.

• Any usage of the material for non-personal and/or for any commercial purpose requires written consent/or permission of the Company.

• The Company reserves the right to discontinue/restrict providing RSS feeds, and can limit the job seeker or any user access to the parts of RSS, without assigning any reason and/or without issuing notice of any kind.

• Resume Spotlight/Resume Forwarding/Resume Engineer Services—These are paid services available to the job seekers on the website “www.kpoplacements.com”. The job seeker should agree with the following terms and conditions regarding access to these services:

• The payment for these services once subscribed by the job seeker is non-refundable and any amount paid shall stand appropriated.

• The subscriber shall use these services only for their own personal benefits, without providing access and/or sharing with any other third person/entity.

• The Company provides no guarantee or warranty that the intended job seeker shall receive a satisfactory response after subscribing to these services.

• Resume spotlight service provides access to the job seeker’s resume from the home page of the website “www.kpoplacements.com” to anyone visiting the website “www.kpoplacements.com”. If required, our experts can help you re-shape or mask any details of your resume.

• The Company shall not be liable or responsible for the loss of any data for any reason whatsoever.

• The Company shall not be responsible for loss of data due to reasons beyond its control like corruption of data, server breakdown, network failure, strikes, riots, civil unrest, tampering of data by unauthorized persons like hackers, war, or other natural calamities.

• The job seeker acknowledges and represents that the information provided by him/her is accurate and true in all respects and he is fully responsible for putting his information under Resume Spotlight service section and its use/misue.

• The Company has the authority to remove/delete and/or edit any information from the job seeker’s resume while uploading or posting it on the website “www.kpoplacements.com”.

• Any disputes arising for whatever reasons from or related to the use of website “www.kpoplacements.com” and/or its services shall be governed by the laws of India. The Courts at New Delhi alone shall have the exclusive jurisdiction to hear and decide on any such dispute.

• It shall be the responsibility of the job seeker to check the authenticity of all the responses received from any other user whether an employer or a consultant or any other stakeholder.

• The job seeker has no right to ask for any information about the prospective employer to whom resume has been delivered or sent by the website “www.kpoplacements.com”. The Company shall be under no legal obligation to provide the job seeker with any such details.

• The Company entails no guarantee or warranty about the employers and/or consultants from whom the intended job seekers might receive call for the interview. It shall be the sole responsibility of the job seeker to perform a thorough background check of the employer or consultant before initiating any discussion or communication with them.

• The Company shall commence/render the services only after it receives the full amount/charges upfront either from the subscriber or from a third party on behalf of the subscriber.

• Any subscription of the aforementioned services is not transferable, that is they are to be availed only by the person subscribing at the start of the services.

• The liability of the Company, if any, shall be limited and shall, in any case whatsoever, not be more than 10% of the amount paid by the subscriber towards subscribing for the services.

• The subscriber shall be solely responsible for the protection of his/her account and password. The Company shall not be responsible for any misuse of the information under "Resume Spotlight, subscriber’s account, in case of any theft, or data loss.

• Acceptable use by the Parties/Users who are Employers and/or Consultants— The Company hereby grants the employers/or recruiters and/or consultants seeking candidates for employment, a limited, terminable, and non-commercial right to access the website “www.kpoplacements.com”. The Company provides authority to the employers to view and access only single copy of contents available on the website “www.kpoplacements.com”, solely for his/her/their own private use of searching and recruiting prospects or job seekers. The employers/recruiters and/or consultants seeking job seekers/prospects agree that he/she or they are solely responsible for the contents of any document uploaded/posted on the website “www.kpoplacements.com” and thereby any consequences arising from any such posting. The Company restricts/prohibits employers and/or recruiters using the services and products of website “www.kpoplacements.com” for any commercial usage or sharing contents, services, or products of the website “www.kpoplacements.com” with any other person/entity without the written consent or agreement with the Company. The Company reserves the right to suspend/terminate the access of the website “www.kpoplacements.com” in case the employer/recruiter is considered to have breached any of the terms and conditions. The employers and/or consultants shall review the terms and conditions that apply on the product and services offered on the website “www.kpoplacements.com”:

• Job Posting/Elite Employers/Employers in Focus/Banners Display—The employer/consultant shall agree to the following conditions with regards to accessing these services. Please note that these services are accessible only upon subscription and only a part of these might be at disposal of the employer/consultant or user free of cost. The employer/consultant shall comply with the following terms and conditions before accessing the website “www.kpoplacements.com”:

• The Company shall place the information relating to jobs or vacancies on the website “www.kpoplacements.com”. 

• The Company holds all the rights to make any modification/edit/or change the details of the jobs/vacancies in order to fit the database.

• The employer/consultant shall not place more than two e-mail Ids for contact for jobs or vacancies posted on the website “www.kpoplacements.com”.

• The Company provides no guarantee or warranty for the satisfactory response with regards to any listing of the job or vacancies on the website “www.kpoplacements.com”.

• It shall be the responsibility of the employer and/or consultant to check the authenticity of all the responses from any other user in form of employees obtained through any of the aforementioned services.

• If the employer/consultant edits/modifies/ or changes any  information in the job posting, it shall be considered as one more job posting is used from subscription package.

• The employer and/or consultant have no right to ask for any information about the prospective employee who might have applied against any listed jobs or vacancies on the website “www.kpoplacements.com”. The Company shall be under no legal obligation to provide the employer and/or consultant with any such details under any of the aforementioned services.

 • Any insertion under the aforementioned services displayed/listed on the website “www.kpoplacements.com” shall be listed for a fixed number of days, and is subject to change without any notice.

• All the jobs/vacancies intimated by the employer and/or consultant and displayed on the website “www.kpoplcements.com” become publicly available and Company may at its sole discretion display the jobs/vacancies on the website “www.kpoplacements.com”.

• The Company shall not be liable or responsible for the loss of any data technical or for any other reasons.

• The Company shall not be responsible for the loss of data due to reasons beyond its control like corruption of data, server breakdown, network failure, and/or but not limited to strikes, riots, civil unrest, tampering of data by unauthorized persons like hackers, war, or other natural calamities.

• The Company shall commence/render the aforementioned services only after it receives the full subscription amount/charges upfront either from the subscriber/or from a third party on behalf of the subscriber.

• Subscription of the aforementioned service is not transferable, that is they are to be availed only by the person/entity subscribing at the start of the services, and not by any other person/entity.

• The employers/consultants shall post or upload only genuine and original jobs/vacancies that are in existence.

• The employers/recruiters and/or consultants acknowledge and agree that they do not charge any fee or money of any kind from the job seekers responding to the advertisements uploaded or posted on the website “www.kpoplacements.com”.

• The employers and/or consultants posting/or uploading the job on the website “www.kpoplacements.com” acknowledge and agree that they have all the licenses or permits that are necessary for employment/or recruitment and indemnify/cover the Company against any disputes and/or claims arising out of the actions/charges that may be made with regards to the same.

 • The Company reserves the right to change the look, feel, description, design, and categorization of any section or page of the website without providing any prior notice to the employers/consultants.

• Only one office of the corporate body and/or employer firm and/or consultant firm shall be entitled for the services and/or products of the website “www.kpoplacements.com”. In case, other offices of the same corporate body want to access the services or products of the website “www.kpoplacements.com”, then they would be required to pay the additional subscription charges for the services.

• It shall be the sole responsibility of the employers and/or consultants to maintain the confidentiality of the password and account given by the Company to upload or post jobs/vacancies on the website “www.kpoplacements.com”. Any misuse or exploitation of the password and account leading to loss of information and/or any sort of damages shall be owned by the employer and/or consultant using the account on the website “www.kpoplacements.com”.      

• Any disputes arising for whatever reasons from or related to the website “www.kpoplacements.com” shall be governed by the laws of India. The Courts at New Delhi alone shall have the exclusive jurisdiction to hear and decide on any such dispute.

• For the subscriber seeking “Banner Display” services, the Company shall display or exhibit all the banners at all the relevant and/or specified locations on a rotation basis as specified by the subscriber.

Anti Spam Policy—The use and access of the “RDS – Resume Database Subscription” is subject to this policy. The Company offers this service to employers and/or consultants solely for providing employment/recruitment solutions. The Company prohibits and restricts the use of the Resume Database for any promotional/marketing, unsolicited messaging, and/or making any unsolicited telephone calls to any party/user. Any subscriber accessing this service agrees to indemnify and hold the Company harmless from any damages, claims and/or charges that may arise out of usage of the KPO Database Accounts for transmitting spam. The subscribers to this service should follow the Terms and Conditions mentioned below:

• Do not send any messages in any form that may be deemed as non-job related mails.

• Do not send extraordinary volumes of mails aimed at one respondent.

• Do not send misleading/or fraud mails.

• Do not send unsolicited bulk messages or unsolicited commercial messages.

Website Usage Restrictions—The Company restricts/prohibits the parties/or users from usage of the website “www.kpoplacements.com” other than the employers/recruiters and/or consultants seeking employees and job seekers/prospects seeking jobs. The parties/users accessing the website should not practice any of the following:

• The party/user accessing the website “www.kpoplacements.com” should not post or upload any incomplete, inaccurate, or false information in any form.

• The party/user (employer, job seeker, or consultant) should not post or upload jobs of the Company’s competitors or any content that promotes/sells information about them.

• The party/user should not use the resume database of website “www.kpoplacements.com” for purposes other than seeking candidates for employment.

• The party/user should not post or upload any content on the website “www.kpoplacements.com” that contains hyperlinks, HTML, hidden links that are irrelevant to the job or are misleading.

• The party/user should not post or upload any franchise, club memberships, distribution, or any other business opportunity.

• The party/user should not send any unsolicited mails, faxes, or make unsolicited phone calls to the users of the website “www.kpoplacements.com”.

• The party/user should not restrict or prohibit any other user from accessing and enjoying any features of the website “www.kpoplacements.com”.

• The party/user should not post or upload any unlawful, threatening, abusive, pornographic, profane, obscene, vulgar, or any form of indecent information on the website “www.kpoplacements.com”.

• The party/user should not post or upload any information, software, or other material which violates or infringes on the rights of other users, including any material which is an invasion of privacy or publicity rights which are protected by the copyright, trademark, or other propriety rights.

The Company does not own any obligation whatsoever regarding the timeliness and effectiveness of the website in meeting the employment objectives of the users.      

• Information Regarding Registration—The party/user intending to register with the website “www.kpoplacements.com” for its usage, shall be asked to submit or provide with some specific personal information including, but not limited to, a valid e-mail address (the “Information”). The Company owns the right to use such information for its own purposes. However, the Company will not disclose any information in form of personal address, e-mail, phone number, and/or any other information deemed personal to the third entity in any form to any organization/vendor or any other body, except to the extent appropriate or necessary to comply with the applicable laws or rules in any legal proceedings where usage of such information is deemed as necessary/unavoidable (except in case of service "Resume Spotlight"). The Company does not provide any warranty or guarantee as to the quality and/or the nature of any third party products and/or services purchased through the website “www.kpoplacements.com”. Any such undertaking, representation, warranty, or guarantee on the purchased product and/or service shall be furnished solely by the provider of the applicable class, product, service, and/or material, as per the terms agreed to by the provider.

The party/user intending to do so consents/agrees to receive communications/messages from the website “www.kpoplacements.com” electronically. The website “www.kpoplacements.com” may interact with the users of the website through e-mails or by posting notices on the website. The party/user accessing the website “www.kpoplacements.com” hereby accepts/agrees that all the agreements, notices, disclosures, and other communications transmitted to the users of the website electronically shall satisfy all the legal requirements that such communications be in writing.
